Library of Things Waiver
By filling out and submitting this form, I state that I have a Cooperative Information Network (CIN) library card in good standing, and that I, and/or my child(ren), or minors to whom I am legal guardian am/are capable, knowledgeable, and experienced in the use of the equipment or tool(s) that I am borrowing. I further agree that I, and/or my child(ren), or minors to whom I am legal guardian, will use the equipment or tool(s) for its/their intended purpose in a safe and proper manner, and that I will not allow any other persons to use the equipment or tool(s) that I am borrowing. I acknowledge that I, and/or my child(ren), or minors to whom I am legal guardian have had a full and fair opportunity to inspect each item that I am borrowing and have advised Coeur d’Alene Public Library of any defects or damage to the equipment or tool(s) that a reasonable inspection would have revealed. I further acknowledge that I, and/or my child(ren), or minors to whom I am legal guardian am/are borrowing the equipment or tool(s) “as is”, without warranty or representations.
I, and/or my child(ren), or minors to whom I am legal guardian, understand that some of the equipment or tools can cause injury to myself or others, even if used properly, and hereby assume the risk of such injury. I therefore, for myself, and/or my child(ren), or minors to whom I am legal guardian, and my successors and my assigns, release and waive all claims against the Coeur d’Alene Public Library, the City of Coeur d’Alene, and their directors, officers, agents, and employees, for any injury, illness, death, or damage to property of any nature which may arise in any way from my use of the equipment or tools. I further, for myself, my child(ren), or minors to whom I am legal guardian, and my successors and assigns, agree to indemnify and hold harmless the Coeur d’Alene Public Library, the City of Coeur d’Alene, and their directors, officers, agents, and employees, from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any person and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from my use of the equipment or tools.
I, and/or my child(ren), or minors to whom I am legal guardian, am/are aware that the Coeur d’Alene Pubic Library, the City of Coeur d’Alene, and their directors, officers, agents, and employees, make no warranties or representations concerning the fitness of any of the equipment or tools for any particular use.
I, and/or my child(ren), or minors to whom I am legal guardian, agree to borrow all equipment and tools from a library staff member at a service desk to ensure that this waiver has been read and signed.
